Kagoshima kills brand name in China
With regard to the case in which the name of “Kagoshima” had been applied for trademark registeration in China, Kagoshima Prefecture on February 27 announced that the brand name had been nullified after China Trade Marks Bureau sided with the prefecture’s petition of objection.
The prefecture had confirmed that an individual in GuangDong Province had applied to China Trade Marks Bureau for trademark application of the name “Kagoshima” in the category of advertisement and business management in January 2008. It filed a dispute in March the same year.
According to the settlement warrant sent to the prefecture from the Chinese bureau, it described Kagoshima as “the name of a prefecture located in the southwestern part of Kyushu, which is the name of a foreign region that is widely recognised by the public;” and thus, it “confirmed that (the name) cannot be used as a trademark.”
